Introduction
This document contains the standard terms of service for products and services operated by Secmatics Limited. By using our web sites, products, or services you agree to the terms contained in this document. This document was last updated on the 30th March 2023.
Intellectual Property
The names, logos, trademarks, visual interfaces, graphics, design, compilation, information, data, computer code, products, software, services, and all other elements of the web sites, products and services that we provide are protected by intellectual property and other laws.
Liability and Warranty
Our web sites, products and services, including without limitation any content delivered as a part thereof, are provided “as is” and on an “as available” basis. Secmatics Limited disclaims all warranties of any kind, whether express or implied, relating to the web sites, products and services and all content delivered in connection thereto, including but not limited to: (a) any implied warranty of merchantability or fitness for a particular purpose; (b) any warranty arising out of course of dealing, usage, or trade relating to availability, accuracy, system integrity, or uninterrupted access. We do not warrant that: (i) the web sites, products or services will be secure or available at any particular time or location; (ii) any defects or errors will be corrected; (iii) any content or software available at or through the web sites, products or services is free of viruses or other harmful components; or (iv) the results of using the web sites, products or services will meet your requirements. Your use of the web sites, products or services is solely at your own risk.
Secmatics Limited is not responsible for the content that you access through your use of our web sites, products and services. To the extent permitted by applicable law, you release us from all liability relating to such content. You acknowledge and agree that we make no representations concerning any content contained in or accessed through the web sites, products and services, and that we are not responsible or liable for the accuracy, quality, legality, or other attributes of such content.
To the fullest extent permitted by law, our aggregate liability to you for all claims arising out of or relating to your use of our web sites, products and services, whether in contract, tort, or otherwise, is limited to the amount you have paid to us for the services at issue in the month prior to the event or circumstance giving rise to any claim.
Billing
Secmatics services that are offered on a subscription basis are typically billed annually in advance. A subscription can be cancelled by providing one month's notice, at the point of cancellation a pro-rated refund will be issued covering any remaining whole months of the subscription.
Prices given on our website or through other quotes will typically be exclusive of any applicable local sales tax or value added tax (VAT). Secmatics is based in the UK but quotes to customers in other locations may be given in the customer's local currency. Unless otherwise stated, all quotes will remain valid for a period of 30 days. Quotes for some services may be contingent on the size or complexity of the customer's infrastructure. If this changes during the subscription period then the customer may need to update their subscription in order to ensure continued coverage of their infrastructure. Payment for subscription or fixed term engagements is required within 15 days of the date of the invoice.
Vulnerability Confidentiality
Any vulnerability details that are discovered through the use of any Secmatics product or service must be treated as confidential information. Identified vulnerabilities that impact a third party product or service may only be disclosed directly to that third party.
